Culture in the Courtroom: Ethnocentrism and Juror Decision-Making.

ABSTRACT: The purpose of this study was to investigate whether a culturally-based argument in a non-insane automatism defense would be detrimental or beneficial to the defendant. We also examined how juror ethnocentrism might affect perceptions of such a defense. Participants read a fictional filicide homicide case in which the defendant claimed to have blacked out during the crime; we manipulated whether culture was used as an explanation for what precipitated the defendant's blackout. We conducted path analyses to assess the role of ethnocentrism in predicting lower defendant credibility, and harsher verdict decisions. Results revealed an interaction between ethnocentrism and defense type, such that ethnocentrism related to lower perceived defendant credibility in the cultural condition, but not in the standard automatism condition. This study marks a starting point for empirically investigating the role of culture in the courtroom, which may aid scholars in discussing the merits of a standalone cultural defense.

Juror decision-making regarding a defendant diagnosed with borderline personality disorder.

Project description:Stigma is an established consequence of the Borderline Personality Disorder (BPD) diagnosis. This diagnosis is subject to revision in the International Classification of Diseases-11th Revision (ICD-11). Using the legal issue of diminished responsibility, this study applied an experimental mock-jury methodology to explore the impact of diagnostic stigma of BPD on jury decision-making. Participants were allocated to one of two versions of a simplified fictitious homicide trial. The group whose defendant was described as having a 'severe personality disorder, borderline pattern' rated the defendant as more dangerous, and more in need of segregation and coercive treatment, than controls where the defendant was described as having a 'complex mental health problem'. Between-group differences in other measures, including the decision to agree a verdict of diminished responsibility, were not found. The ICD-11 'severe personality disorder, borderline pattern' diagnosis may adversely impact the attitudes of jurors considering the question of diminished responsibility.

The impact of misinformation presented during jury deliberation on juror memory and decision-making.

Project description:When deliberating, jurors may introduce misinformation that may influence other jurors' memory and decision-making. In two studies, we explored the impact of misinformation exposure during jury deliberation. Participants in both studies read a transcript of an alleged sexual assault. In Study 1 (N = 275), participants encountered either consistent pro-prosecution misinformation, consistent pro-defense misinformation, or contradictory misinformation (pro-prosecution and pro-defense). In Study 2 (N = 339), prior to encountering either pro-prosecution or pro-defense misinformation while reading a jury deliberation transcript, participants either received or did not receive a judicial instruction about misinformation exposure during deliberation. Participants in both studies completed legal decision-making variables (e.g., defendant guilt rating) before and after deliberation, and their memory was assessed for misinformation acceptance via recall and source memory tasks. In Study 1, misinformation type did not influence legal decision-making, but pro-prosecution misinformation was more likely to be misattributed as trial evidence than pro-defense or contradictory misinformation. In Study 2, pro-defense misinformation was more likely to be misattributed to the trial than pro-prosecution misinformation, and rape myths moderated this. Furthermore, exposure to pro-defense misinformation skewed legal decision-making towards the defense's case. However, the judicial instruction about misinformation exposure did not influence memory or decision-making. Together, these findings suggest that misinformation in jury deliberations may distort memory for trial evidence and bias decision-making, highlighting the need to develop effective safeguards for reducing the impact of misinformation in trial contexts.

The Effect of Delayed Reporting on Mock-Juror Decision-Making in the Era of #MeToo.

Project description:The #MeToo movement has given voice to victims of sexual harassment and assault. In many of these cases, there have been long delays in reporting of the sexual offence (e.g., the Harvey Weinstein case). The purpose of this study was to examine how the type of sexual offence (harassment vs. assault) and the length of delayed reporting (15, 25, 35 years) influenced mock-juror decision-making. Mock-jurors (N = 319) read a mock trial transcript depicting an alleged sexual offence and were asked to render a dichotomous verdict, continuous guilt rating, and defendant and victim perception ratings. The data indicated an effect of sexual offence type such that mock-jurors held more favorable perceptions of the defendant when the alleged offence was harassment compared with assault. There also was an effect of delayed reporting such that mock-jurors rendered more guilty verdicts when there was a 25-year delay compared with a 15-year delay. Intriguingly, these results suggest that jurors in sexual offence cases may perceive longer delays in reporting as more believable than shorter delays.

Judges versus artificial intelligence in juror decision-making in criminal trials: Evidence from two pre-registered experiments.

Project description:BackgroundArtificial intelligence (AI) is anticipated to play a significant role in criminal trials involving citizen jurors. Prior studies have suggested that AI is not widely preferred in ethical decision-making contexts, but little research has compared jurors' reliance on judgments by human judges versus AI in such settings.ObjectivesThis study examined whether jurors are more likely to defer to judgments by human judges or AI, especially in cases involving mitigating circumstances in which human-like reasoning may be valued.MethodsTwo pre-registered online experiments were conducted with Japanese participants (Experiment 1: N = 1,735, Mage = 48.4; Experiment 2: N = 1,731, Mage = 48.5). Participants reviewed two murder trial vignettes and made sentencing decisions (1 = suspended sentence; 8 = prison sentence) under two conditions: trials with and without mitigating circumstances.Results and conclusionAcross both experiments, participants showed no preference for deferring to human judges' or AI judgments when making sentencing decisions. While suspended sentences were more common in cases with mitigating circumstances, this tendency was unrelated to the judgment source. These findings suggest that jurors do not inherently avoid algorithmic judgments and may consider AI opinions on par with those of human judges in certain contexts. However, whether this leads to improved decision-making quality remains an open question, as objectivity (a strength of AI) and emotional considerations (a safeguard for fairness) may interact in complex ways during juror deliberations. Future research should further explore how these factors influence juror attitudes and decisions in diverse trial scenarios, taking into account potential biases in existing literature.

Project description:This study aimed to investigate whether deficits in decision making were potential endophenotype markers for OCD considering different phases of the disease. Fifty-seven non-medicated OCD patients (nmOCD), 77 medicated OCD patients (mOCD), 48 remitted patients with OCD (rOCD) and 115 healthy controls were assessed with the Iowa Gambling Task (IGT), which measured decision making under ambiguity, and the Game of Dice Task (GDT), which measured decision making under risk. While the three patients groups showed impaired performance on the IGT compared with healthy controls, all patients showed intact performance on the GDT. Furthermore, the rOCD patients showed a preference for deck B, indicating that they showed more sensitivity to the frequency of loss than to the magnitude of loss, whereas the mOCD patients showed a preference for deck A, indicating that they had more sensitivity to the magnitude of loss than to the frequency of loss. These data suggested that OCD patients had trait-related impairments in decision making under ambiguity but not under risk, and that dissociation of decision making under ambiguity and under risk is an appropriate potential neurocognitive endophenotype for OCD. The subtle but meaningful differences in decision making performance between the OCD groups require further study.

Project description:This study evaluated how differences in economic risk-taking in Westerners and East Asians reflect cultural differences in the analytic or holistic processing of probabilistic outcomes during value-based decisions. Twenty-seven Americans (US) and 51 Taiwanese (TW) young adults completed a functional magnetic resonance imaging (fMRI) Lottery Choice Task (LCT) experiment. Participants accepted or rejected stakes with varying probabilities of winning or losing different magnitudes of points. TW participants accepted more stakes when win probabilities were > 0.50, whereas US participants reduced their acceptance rates of winning stakes more discriminately as win probabilities decreased. Both groups rejected losing stakes (win probabilities < 0.50) with similar frequency. Critically, ventromedial prefrontal cortex (VMPFC) responses correspondingly showed greater discrimination between win probability conditions in US than TW groups. Our findings highlight a neurocognitive mechanism in the VMPFC for how cultural differences in distinguishing between probabilistic reward outcomes shape neural computations of risk and prospects.

Asymmetric quantum decision-making.

Project description:Collective decision-making plays a crucial role in information and communication systems. However, decision conflicts among agents often impede the maximization of potential utilities within the system. Quantum processes have shown promise in achieving conflict-free joint decisions between two agents through the entanglement of photons or the quantum interference of orbital angular momentum (OAM). Nonetheless, previous studies have shown symmetric resultant joint decisions, which, while preserving equality, fail to address disparities. In light of global challenges such as ethics and equity, it is imperative for decision-making systems to not only maintain existing equality but also address and resolve disparities. In this study, we investigate asymmetric collective decision-making theoretically and numerically using quantum interference of photons carrying OAM or entangled photons. We successfully demonstrate the realization of asymmetry; however, it should be noted that a certain degree of photon loss is inevitable in the proposed models. We also provide an analytical formulation for determining the available range of asymmetry and describe a method for obtaining the desired degree of asymmetry.

Countermanding Perceptual Decision-Making.

Project description:We investigated whether a task requiring concurrent perceptual decision-making and response control can be performed concurrently, whether evidence accumulation and response control are accomplished by the same neurons, and whether perceptual decision-making and countermanding can be unified computationally. Based on neural recordings in a prefrontal area of macaque monkeys, we present behavioral, neural, and computational results demonstrating that perceptual decision-making of varying difficulty can be countermanded efficiently, that single prefrontal neurons instantiate both evidence accumulation and response control, and that an interactive race between stochastic GO evidence accumulators for each alternative and a distinct STOP accumulator fits countermanding choice behavior and replicates neural trajectories. Thus, perceptual decision-making and response control, previously regarded as distinct mechanisms, are actually aspects of a common neuro-computational mechanism supporting flexible behavior.

Composite collective decision-making.

Project description:Individual animals are adept at making decisions and have cognitive abilities, such as memory, which allow them to hone their decisions. Social animals can also share information. This allows social animals to make adaptive group-level decisions. Both individual and collective decision-making systems also have drawbacks and limitations, and while both are well studied, the interaction between them is still poorly understood. Here, we study how individual and collective decision-making interact during ant foraging. We first gathered empirical data on memory-based foraging persistence in the ant Lasius niger. We used these data to create an agent-based model where ants may use social information (trail pheromones), private information (memories) or both to make foraging decisions. The combined use of social and private information by individuals results in greater efficiency at the group level than when either information source was used alone. The modelled ants couple consensus decision-making, allowing them to quickly exploit high-quality food sources, and combined decision-making, allowing different individuals to specialize in exploiting different resource patches. Such a composite collective decision-making system reaps the benefits of both its constituent parts. Exploiting such insights into composite collective decision-making may lead to improved decision-making algorithms.

Decision making in xia2.

Project description:xia2 is an expert system for the automated reduction of macromolecular crystallography (MX) data employing well trusted existing software. The system can process a full MX data set consisting of one or more sequences of images at one or more wavelengths from images to structure-factor amplitudes with no user input. To achieve this many decisions are made, the rationale for which is described here. In addition, it is critical to support the testing of hypotheses and to allow feedback of results from later stages in the analysis to earlier points where decisions were made: the flexible framework employed by xia2 to support this feedback is summarized here. While the decision-making protocols described here were developed for xia2, they are equally applicable to interactive data reduction.
