A study of auxiliary factors for judges in sentencing dangerous driving offenses - the mediating role of favorable and unfavorable factors.

ABSTRACT: This paper investigates the ancillary factors judges consider when sentencing dangerous driving offenses. These factors are divided into favorable (i.e., "Confess" [CF], and "Actively compensate and obtain forgiveness from victims" [AC]) and unfavorable categories (i.e., "Mainly or solely responsible for the accident" [MSR], and "Post-accident behavior" [BAA]). Results indicate that both types of factors mediate the relationship between "Blood Alcohol Concentration" (BAC) and the sentencing outcome: favorable factors have a significant negative correlation with sentences, while unfavorable ones show a positive correlation. The mediation effect ratios are 13.8% and 19.1% respectively, with no significant differences between their impacts on judges' sentencing decisions.

Comparing sentencing judgments of judges and laypeople: The role of justifications.

Project description:There is a lack of understanding concerning the differences between laypeople's and professional judges' conceptions of justifications for sentencing. We conducted an online quasi-experimental study with 50 active judges and 200 laypeople. Participants were presented with a vignette describing severe child abuse leading to fatality and were asked to indicate a term of imprisonment for the father and the justification they would consider relevant when deciding on the sentence. A two-factor analysis of variance showed that laypeople disproportionately favored retribution compared to judges. This was reflected in the judges' higher scores for the other three justifications (incapacitation, general deterrence, rehabilitation). The Likert scales failed to detect any such differences. Furthermore, imprisonment terms given by judges were shorter than those given by laypeople. These results support the hypotheses that judges balance multiple justifications and find a shorter sentence that is appropriate; their lesser bias toward retribution supports the notion that judges should be balanced and fair-minded.

Expressing Anger Is More Dangerous than Feeling Angry when Driving.

Project description:Anger is an emotion that drivers often feel and express while driving, and it is believed by researchers to be an important cause of dangerous driving behavior. In this study, the relationships between driving trait anger, driving anger expression, and dangerous driving behaviors were analyzed. The Driving Anger Scale (DAS) was used to measure driving trait anger, whereas the Driving Anger Expression (DAX) Inventory was used to measure expressions of driving anger. A sample of 38 drivers completed the DAS, DAX, and a driving simulation session on a simulator where their driving behaviors were recorded. Correlation analysis showed that the higher scores on the DAS were associated with longer durations of speeding in the simulator. The more participants expressed their anger in verbal and physical ways, the more likely they were to crash the virtual vehicle during the simulation. Regression analyses illustrated the same pattern. The findings suggest that, although trait anger is related to speeding, the passive expression of anger is the real factor underling traffic accidents. This study extends findings about the predictive effects of self-report scales of driving behaviors to behaviors recorded on a simulator. Thus, if in traffic safety propaganda, guiding drivers to use positive ways to cope with driving anger is recommended by our findings.

Driving and Multitasking: The Good, the Bad, and the Dangerous.

Project description:Previous research has shown that multitasking can have a positive or a negative influence on driving performance. The aim of this study was to determine how the interaction between driving circumstances and cognitive requirements of secondary tasks affect a driver's ability to control a car. We created a driving simulator paradigm where participants had to perform one of two scenarios: one with no traffic in the driver's lane, and one with substantial traffic in both lanes, some of which had to be overtaken. Four different secondary task conditions were combined with these driving scenarios. In both driving scenarios, using a tablet resulted in the worst, most dangerous, performance, while passively listening to the radio or answering questions for a radio quiz led to the best driving performance. Interestingly, driving as a single task did not produce better performance than driving in combination with one of the radio tasks, and even tended to be slightly worse. These results suggest that drivers switch to internally focused secondary tasks when nothing else is available during monotonous or repetitive driving environments. This mind wandering potentially has a stronger interference effect with driving than non-visual secondary tasks.

Examining Bayesian network modeling in identification of dangerous driving behavior.

Project description:Traffic safety problems are still very serious and human factor is the one of most important factors affecting traffic crashes. Taking Next Generation Simulation (NGSIM) data as the research object, this study defines six control indicators and uses principal component analysis and K-means++ clustering methods to get the driving style of different drivers. Then use the Bayesian Networks Toolbox (BNT) and MCMC algorithm to realize the structure learning of Bayesian network. and parameter learning was completed through Netica software. Finally, the vehicle-based traffic crash risk model was created to conduct sensitivity analysis, posterior probability inference, and simulation data was used to detect the feasibility of the model. The results show that the Bayesian network modeling can not only express the relationship between the crash risk and various driving behaviors, but also dig out the inherent relationship between different influencing factors and investigate the causes of driving risks. The results will be beneficial to accurately identify and prevent risky driving behavior.

The relationship between lifestyle, driving anger and dangerous driving behaviours-An explorative study in a Chinese sample.

Project description:Drivers who exhibit dangerous driving behaviours, such as aggressive, risky, and negative emotion cognition driving, are more likely to be involved in road crashes. A key motivator behind unsafe driving behaviours is driving anger. However, it is unclear whether lifestyle, driving anger, and dangerous driving behaviours are related. A total of 344 Chinese drivers with a formal driving license were asked to complete the socio-demographic information, the Chinese lifestyle questionnaire (Self-designed), the 14 items Driving Anger Scale (DAS), and the Dula Dangerous Driving Index (DDDI). The Chinese driver's lifestyles were analysed using Exploratory Factor Analysis (EFA), revealing a four-factor structure ("Culture", "Workaholism", "Sports" and "Amusement"). The 14 items DAS factor structure was determined using a Confirmatory Factor Analysis (CFA), yielding a two-factor structure ("Safety Concern anger" and "Arrival Concern anger"). Based on Hierarchical Multiple Regression (HMR), only "Workaholism" was associated with aggressive, risky, and negative emotion cognition driving. The trait driving anger was examined as a mediator between the "Workaholism" and dangerous driving (aggressive, risky, and negative emotion cognition driving) through a Structural Equation Modelling (SEM) approach. "Workaholism" was shown to influence these dangerous driving behaviours through trait driving anger. Lastly, this article discussed the theoretical and practical implications and research limitations.

Transcriptome profiling between unfavorable and favorable Wilms Tumors and against human fetal kidney

Project description:Purpose: The 10x Genomics Visium platform allows us to define the spatial topography of gene expression and provides detailed molecular maps that overcome limitations associated with sn/scRNA-seq and microscopy-based spatial transcriptomics methods. The goals of this study are to compare and identify unique transcriptome profiling (RNA-seq) signature between unfavorable and favorable Wilms Tumors and against human fetal kidney. Methods: Human fetal kidney and Wilms tumor spatial topography of gene expression were generated using the 10X Visium platform Results: Using an optimized data analysis workflow, we mapped the reads to the hg38 genome build and grouped the spots into 9 clusters based on gene expression profiles. Conclusion: Our study represents the first implement of Visium technology in human fetal kidney and Wilms Tumor tissue, providing a number of important functional insights about the spatial and molecular definitions of cell populations across human fetal kidney and different subtypes of Wilms Tumor through analyzing gene expression within the intact spatial organization of the human samples.

Unfavorable and favorable changes in modifiable risk factors and incidence of coronary heart disease: The Whitehall II cohort study.

Project description:BackgroundFew studies have examined long-term associations of unfavorable and favorable changes in vascular risk factors with incident coronary heart disease (CHD). We examined this issue in a middle-aged disease-free population.MethodsWe used repeat data from the Whitehall II cohort study. Five biomedical, behavioral and psychosocial examinations of 8335 participants without CHD produced up to 20,357 person-observations to mimic a non-randomized pseudo-trial. After measurement of potential change in 6 risk factors twice (total cholesterol, blood pressure, smoking, overweight, psychological distress, problems in social relationships), a 5-year follow-up of CHD was undertaken.ResultsIncidence of CHD was 7.4/1000 person-years. Increases from normal to high cholesterol (hazard ratio, HR = 1.59, 95% CI 1.26-2.00) and from normal to high blood pressure (HR = 1.64, 95% CI 1.33-2.03), as compared to remaining at the normal level, were associated with increased risk of CHD. In contrast, decreases from high to low levels of cholesterol (HR = 0.73, 95% CI 0.58-0.91), psychological distress (HR = 0.68, 95% CI 0.51-0.90), and problems in social relationships (HR = 0.65, 95% CI 0.50-0.85), and quitting smoking (HR = 0.49, 95% CI 0.29-0.82) were associated with a reduced CHD risk compared to remaining at high risk factor levels. The highest absolute risk was associated with persistent exposure to both high cholesterol and hypertension (incidence 18.1/1000 person-years) and smoking and overweight (incidence 17.7/1000 person-years).ConclusionsWhile persistent exposures and changes in biological and behavioral risk factors relate to the greatest increases and reductions in 5-year risk of CHD, also favorable changes in psychosocial risk factors appear to reduce CHD risk.

Favorable and unfavorable health conditions within OECD countries: An exploratory study.

Project description:ObjectivesThis study compared the physical, mental, and social health levels among Organization for Economic Co-operation and Development countries.MethodsWe sampled from 34 Organization for Economic Co-operation and Development member countries and divided physical, mental, and social health into three domains based on World Health Organization health definitions.ResultsA multivariate hierarchical cluster analysis was conducted to group countries that were similar in terms of health. Regarding physical health, Japan, South Korea, Sweden, Switzerland, and ten more countries reported favorable health conditions. For mental health, Australia, Canada and eight more countries revealed favorable conditions. Finally, in terms of social health, Austria, Finland, Iceland, and seven more countries reported favorable conditions. Sweden and Switzerland reported the best health conditions aggregated across all three domains. Conversely, Estonia, Hungary, and Turkey reported comparatively poorer health across all three domains when compared with other Organization for Economic Co-operation and Development countries.ConclusionsWe suggested that mental health policy should be further strengthened in cases of Korea and Japan. In case of the Eastern Bloc countries, health policies should be established focusing on health equity for effective improvement of indicators.

Are Supervision Violations Filling Prisons? The Role of Probation, Parole, and New Offenses in Driving Mass Incarceration.

Project description:Advocates for reform have highlighted violations of probation and parole conditions as a key driver of mass incarceration. As a 2019 Council of State Governments report declared, supervision violations are "filling prisons and burdening budgets." Yet few scholarly accounts estimate the precise role of technical violations in fueling prison populations during the prison boom. Using national surveys of state prison populations from 1979 to 2016, the authors document that most incarcerated persons are behind bars for new sentences. On average, just one in eight people in state prisons on any given day has been locked up for a technical violation of community supervision alone. Thus, strategies to substantially reduce prison populations must look to new criminal offenses and sentence length.

Deep sequencing reveals differential expression of microRNAs in favorable versus unfavorable neuroblastoma.

Project description:Small non-coding RNAs, in particular microRNAs(miRNAs), regulate fine-tuning of gene expression and can act as oncogenes or tumor suppressor genes. Differential miRNA expression has been reported to be of functional relevance for tumor biology. Using next-generation sequencing, the unbiased and absolute quantification of the small RNA transcriptome is now feasible. Neuroblastoma(NB) is an embryonal tumor with highly variable clinical course. We analyzed the small RNA transcriptomes of five favorable and five unfavorable NBs using SOLiD next-generation sequencing, generating a total of >188 000 000 reads. MiRNA expression profiles obtained by deep sequencing correlated well with real-time PCR data. Cluster analysis differentiated between favorable and unfavorable NBs, and the miRNA transcriptomes of these two groups were significantly different. Oncogenic miRNAs of the miR17-92 cluster and the miR-181 family were overexpressed in unfavorable NBs. In contrast, the putative tumor suppressive microRNAs, miR-542-5p and miR-628, were expressed in favorable NBs and virtually absent in unfavorable NBs. In-depth sequence analysis revealed extensive post-transcriptional miRNA editing. Of 13 identified novel miRNAs, three were further analyzed, and expression could be confirmed in a cohort of 70 NBs.
